Regulations for the Establishment of a Municipal Council at Harbin.*
(Abstract of Translation.)
ARTICLE 1 provides for an elective Town Council. Superintendence over legal functions of such Council to be in hands of President of the Eastern Chinese Railway Company.
Article 2 describes functions of said Council
(a.) Management of taxes and dues, town property and finance, maintenance of streets, bridges, wharfs, sewerage, lighting, &c.
(b.) Stores for the sale of firewood, bread, and meat to be under public management.
(c.) Management of medical and sanitary department, hospitals and cemeteries.
(d) Supervision of charities and benevolent institution.
(e.) Organization and maintenance of schools, libraries, theatres, &c.
(f) Attention to development of local trade, arrangement of markets, and institution of regulations between employers and employés in manufacturing and industrial establishments.
(g.) Maintenance of tramways, omnibuses, and steam-boats.
(h.) Supervision over building, &c.
Article 3. Public property (roads, parks, squares, &c.) not to be alienated by Council without consent of the Railway Company.
Article 4. The Council to be a legal entity.
Article 5. Right of Council to impose taxation for the requirements of the town.
Article 7. The Council to place 5 per cent. of its revenues at the disposal of the Railway Company, and also to bear part of the expenses of the Harbin police.
Article 8. All persons to pay taxes at the same rate. Arrears to be collected by the police.
Article 9. Power to make Regulations obligatory on all residents, and to institute prosecutions in case of infractions.
Article 10. Municipal management to consist of--
(1.) An assembly of citizens.
(2.) A Town Council.
Articles 11 to 31. Rules for the election of delegates to the Assembly, seventy-two in number; qualification of voters, disabilities, method of voting, &c.
Articles 31 to 41. Functions of delegates. Unimportant.
Article 42. The Town Council to consist of a chairman and five members, of whom three shall be elected and two appointed by the Railway Company.
Article 43. Chairman must be a Russian subject. Term of office of Council, three years.
Articles 44 and 45. Rules for election of chairman and Council.
Article 46. Council to be paid for their services.
Article 47. Council to supervise the executive of the public Administration.
Article 48. Not less than four members to form a quorum.
Article 49. All proceedings must be reported to the manager of the Railway Company.
Article 50. All business to be conducted in Russian.
Article 51. All relations of the municipal shall be conducted not otherwise than with the consent of the management of the railway.
Article 52. All rules instituted by the general management shall be effective on all residents and establishments in the town and territory of Harbin.
Article 53. In the surrender of land to foreigners there shall be taken from such foreigners a signed pledge that they will obey all police and municipal Rules and Regulations, permanent and temporary, and also those which are to be formulated. When foreigners sign such pledges, their Consuls on the territory should give evidence that the pledges are signed or given with their knowledge and consent.
Article 64. Disputes between the municipal management and the railway management shall be decided by the general management.

Obligatory Rules for Residents in Harbin Railway Settlement.
(Abstract of Translation.)
1. NO person to open a trade or industrial establishment without a licence from the Railway Company.
2. Lays down conditions under which the licences will be granted, fees payable, &c.
3. All persons of the trade superintendency shall have the right to go into the trade and industrial establishments where trade or business is being conducted for purposes of inspection.
4. Any infraction of Rules to be punished by fine not exceeding 100 roubles or imprisonment for one month.

AVEC le développement de Harbin et d'autres localités situées sur la ligne du Chemin de Fer Chinois de l'Est un assez grand nombre d'étrangers sont venus y résider, et certains d'entre eux sont devenus, ou ont l'intention de devenir, acquéreurs de terrains ou d'immeubles situés sur le territoire appartenant au chemin de fer. Il est évident que par ce fait même ces étrangers se mettent en certaines relations juridiques vis-à-vis des autorités gérant ce territoire.
Afin d'éviter tout malentendu en ce qui concerne les droits de la Société du Chemin de Fer Chinois de l'Est concernant l'administration des terrains lui appartenant, et prenant en considération qu'il existe des textes non autorisés du Traité passé entre le Gouvernement Chinois et la Banque Russo-Chinoise le 27 Août (8 Septembre), 1896, concernant la construction du chemin de fer en Manchourie, j'ai l'honneur de vous communiquer ci-dessous le texte Français, seul autorisé, de l'Article VI de ce Traité définissant les droits administratifs du chemin de fer concernant le territoire lui appartenant. Comme vous voudrez bien remarquer, la Société du Chemin de Fer possède le droit absolu et exclusif de l'administration de ses terrains.
Voici le texte de l'Article en question :
"Les terrains réellement nécessaires pour la construction, exploitation, et protection de la ligne, ainsi que les terrains aux environs de la ligne, nécessaires pour se procurer des sables, pierres, chaux, &c., seront remis à la Société gratuitement, si ces terrains sont la propriété de l'État; s'ils appartiennent à des particuliers, ils seront remis à la Société contre un seul payement ou une location annuelle aux propriétaires au prix courant.
Les terrains appartenant à la Société seront exempts de tout impôt foncier.
"La Société aura le droit absolu et exclusif de l'administration de ses terrains.
"La Société aura le droit de construire sur ses terrains des constructions de tout genre et également de construire et d'exploiter le télégraphe nécessaire pour les besoins de la ligne.
"De même, les revenus de la Société, toutes ses recettes et les tarifs pour le transport de voyageurs et marchandises, télégraphes, &c., seront exempts de tout impôt et droit. Exception est faite pour les mines pour lesquelles il y aura un arrangement spécial."
Je vous serais bien reconnaissant, M. le Ministre et cher collègue, de vouloir bien porter ce qui précède à la connaissance des ressortissants Anglais ayant des intérêts sur le territoire du chemin de fer. Je crois devoir en même temps prier votre Excellence d'inviter les autorités Consulaires Anglaises en Manchourie de s'adresser pour toute explication ou réclamation concernant les intérêts de leurs ressortissants sur le dit territoire, et spécialement à Harbin, au Consul-Général de Russie dans cette ville, ce dernier étant chargé de servir d'intermédiaire entre les Représentants Consulaires
